Effective: October 2026
This End User License Agreement (the “Agreement”) governs your access to and use of the GovCon Video Game platform, including its game mechanics, contracting simulations, digital courseware, pixel art, AI officers, and related services (collectively, the “Software”). By creating an account, paying the license fee, or accessing the Software, you agree to this Agreement.
1. AGREEMENT & DEFINITIONS “We,” “us,” and “Company” mean WealthTech Holdings Inc., the publisher and operator of the GovCon Video Game. “You” means the individual using the Software.
2. LICENSE GRANT Subject to your compliance with this Agreement and payment of the applicable one-time Founder's Edition fee (or other applicable access fees), we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software for your own personal educational and entertainment purposes. The Software is licensed, not sold. We reserve all rights not expressly granted here.
3. PERMITTED USE You may use the Software to play the game, simulate government contracting scenarios, learn the basics of the Federal Acquisition Regulation (FAR), create a simulated corporate entity, and interact with the digital Command Center.
4. RESTRICTIONS You may not, and may not permit anyone else to:
resell, rent, lease, sublicense, or otherwise commercialize the Software, your account, or any content in it;
share, transfer, or allow another person to use your account credentials;
copy, mirror, or republish the game’s art, code, mechanics, or simulations;
extract content in bulk by scraping, crawling, automated download, headless browsers, or AI agents;
use the Software to train, fine-tune, or evaluate any machine learning model;
reverse engineer, decompile, or attempt to derive source code except to the extent that restriction is unenforceable by law;
circumvent access controls, paywalls, or database Row-Level Security (RLS) policies;
probe, scan, or stress-test our systems without written authorization;
upload malicious code; or
use the Software in any way that violates applicable law.
Nothing in the Software, including generated UEI codes, CAGE codes, or NAICS designations, may be used to bid on actual government contracts or presented as real-world corporate credentials.
5. ACCOUNTS & SECURITY RESPONSIBILITIES You are responsible for the accuracy of your registration information, for safeguarding your credentials, and for all activity under your account. You must notify us promptly of any suspected unauthorized use. We may suspend an account we reasonably believe is compromised or being shared across multiple users. You must be legally able to enter this Agreement (at least 18 years of age).
6. ACCESS FEES & REFUNDS Access to the full Command Center and gameplay loop requires the purchase of a digital license (e.g., the Founder's Edition). Pricing is stated at checkout. Because the Software is immediately unlocked and playable upon successful payment, all sales are final, and refunds are generally not provided except where strictly required by applicable law.
7. INTELLECTUAL PROPERTY The Software and all content in it, including game mechanics, simulated scenarios, pixel and isometric artwork, audio, UI/UX designs, and the compilation of all of the foregoing, are owned by WealthTech Holdings Inc. or its licensors and are protected by copyright, trademark, and other laws. In-game company profiles, digital bank balances, and simulated contracts remain the property of the platform and hold no real-world value.
8. USER CONTENT & FEEDBACK You retain ownership of the specific text inputs you submit for your simulated company. You grant us a worldwide, royalty-free license to host, store, process, and display that content solely to operate the Software. Suggestions, bug reports, and feedback you submit may be used by us without obligation or compensation.
9. THIRD-PARTY SERVICES & AI The Software relies on third-party providers for hosting (Supabase), payments (PayPal), and AI model inference (Google Gemini). Those providers operate under their own terms. AI-generated contracting officers and bid feedback are processed server-side and may produce inaccurate or "hallucinated" information. You are solely responsible for understanding that this is a simulated game mechanic.
10. EDUCATIONAL & CONTRACTING DISCLAIMER The Software is an educational strategy game. It is NOT legal, business, accounting, or official government contracting advice, and no advisory relationship is created by using it. Simulated contracting, bidding, and banking scenarios use synthetic outcomes and do not predict real-world success in the federal marketplace. We are not affiliated with, endorsed by, or sponsored by the U.S. Government, the General Services Administration (GSA), the Small Business Administration (SBA), the Department of Defense (DoD), or any other federal or state agency.
11. WARRANTY DISCLAIMER & LIMITATION OF LIABILITY The Software is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost real-world contracting opportunities, or lost data. Our total aggregate liability arising out of or relating to the Software and this Agreement will not exceed the amount you paid for your license.
12. INDEMNIFICATION You agree to indemnify and hold harmless WealthTech Holdings Inc., its officers, employees, and contractors from claims, damages, liabilities, and reasonable costs arising from your use of the Software in violation of this Agreement, your attempt to use simulated game data in real-world business, or from content you submit.
13. TERM, SUSPENSION & TERMINATION This Agreement applies for as long as you access the Software. We may suspend or terminate access immediately for breach of this Agreement, suspected account sharing, piracy, or conduct that threatens platform integrity. You may stop using the Software at any time. On termination, your license ends. Sections covering intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
14. GOVERNING LAW & DISPUTE RESOLUTION This Agreement is governed by the laws of the State of Texas, excluding its conflict of laws rules. The parties will first attempt to resolve any dispute informally by written notice and good-faith discussion for thirty days. Unresolved disputes are subject to the exclusive jurisdiction of the state and federal courts located in Texas, and each party consents to venue there. You waive any right to a trial by jury and to participate in any class action.
15. CHANGES & CONTACT We may update this Agreement to reflect changes in the Software or applicable law. Continued use after an update constitutes acceptance. Questions about this Agreement may be sent to Contact@SmartConsultingGroup.org.
